Definitions
All references to 'you &/or your' means you either plural or singular; the viewer, the user, the purchaser, the customer.
All references to 'we, us or our' means N10 Bourbons Limited.
All references to 'the site' means www.nativespiritsonline.com.
Jurisdiction
These Terms and Conditions, including the Privacy Statement and any matter relating to 'the site' shall be governed by English law in particular the Licensing Act 2003 in relation to minimum legal age for purchasing and consuming alcohol.
Any legal proceeding arising out of or relating to these Terms and Conditions against or relating to us, or any indemnified party under these Terms and Conditions, will be subject to the exclusive jurisdiction of the English courts and you irrevocably consent to the jurisdiction of such courts.
Use
Any use of this website www.nativespiritsonline.com operated by N10 Bourbons Limited 'the site' is conditional on your acceptance of these terms and conditions of use and extends to our stated privacy policy.
We reserve the right to amend these Terms and Conditions from time to time without notice and at our sole discretion. As such, it is your responsibility to review these stated Terms and Conditions at regular intervals.
We reserve the right to amend, modify, discontinue or suspend all or part of the site and may restrict your access to all or part of the site at any time without notice or liability.
The site is intended to be used and accessed only by individuals of legal drinking age in their country of residence, or in the country from which you are accessing the site.

By using the site and/or placing an order with us you are agreeing to the following Terms and Conditions of sale:
Products
We supply fine, rare and collectable bourbon, whiskey and rye. As such, the products on our site are either limited edition and or new, stored or sourced externally through third parties, collectors and resellers.
All descriptive matter and specifications are for the sole purpose of providing a portrayal of the product that is for sale. It is based on the information on the bottle and our research from distiller literature, books and desktop research. Whilst we go to great lengths to ensure this information is verified, accurate and true, we will not be held liable for incorrect information.
Condition
Some of the products we offer span over a century of production and bottling and as such the condition of bottles, labels, seals and contents are variable. We endeavour to source the best available examples and to supply them to you at affordable prices.
Due to the age of some of our bottles we cannot guarantee that all stock is in 100% perfect condition. Some items are so rare, that there might be presentational compromises with labels, presentation boxes or seals, and some bottles of unfiltered rye may suffer from clouding. We cannot guarantee the condition of a bottle's cork, seal or closure and the condition of liquid is at the buyer's discretion. Because of the age and condition of some bottles, we cannot accept responsibility for failure/leakage in transit.
The products displayed on our site and the images are of the actual bottles for sale, unless otherwise stated, so please pay close attention to the pictures and look for bottle condition and fill level.
Availability
Whilst we operate a real time inventory system a large number of our products are rare and produced in limited quantities. As such, all orders accepted, are subject to the availability of stock at the time of placing your order. We therefore reserve the right to cancel an order if the product is no longer available at the moment of purchase. If your order is not fulfilled you will receive a full refund and we will endeavour to offer you a replacement product at a similar price.
We try to ensure the accuracy of stock information on the site and the information provided to our affiliates that link to our site. Should a product be unavailable when you link through to the site from a third party website please contact us and we will do our best to source a bottle for you.
Pricing
Orders placed with us are processed in British Sterling and in the English language. Any non-sterling prices displayed on the website using the site's multiple currency feature are subject to constantly changing exchange-rate fluctuations and as such may differ from minute to minute and due to a different rate being used by your bank, payment provider or gateway.
All prices shown on the website are inclusive of statutory United Kingdom Value Added Tax (VAT) at 20%. Orders being delivered to destinations outside of the European Union will not be charged VAT if they were purchased by Native Spirits on the primary market.
We make every effort to make our pricing as transparent as possible. However, due to the liquidity of our market and rarity of some items, prices may vary from week to week and can change without notice.
We reserve the right to amend our prices without notice where necessary
Affiliates and third party websites might link a product quoted at a particular price to the site that is for sale on the site at a different price. In this instance the price advertised on the site is the sale price, unless *
Items of a particular product or vintage will be different from its namesake of a different release.
*We will not be obliged to honour any orders where there has been a computer or systems error/malfunction, or our computer systems have been hacked or compromised
Purchasing from us
Alcohol may only be purchased if you are of the appropriate legal age for your country, which is 21 years old in the United States, 18 years old in the UK and up to 21 years old in other countries. Users under the legal drinking age in their country must not order from us or enter the site.
It is your responsibility to make sure we ship to your location before placing your order
We are unable to process your order until your payment has been received, your Credit/Debit/Charge card has been authorised and or proof of address verified.
No items, or title of goods shall pass from us to you until payment has been received in full.
Customers are responsible for the suitability of the goods they are purchasing. Products are not supplied on a trial basis and if any product supplied is not used for its intended purpose, subjected to abuse or unreasonable usage, this will contravene the terms of our returns policy.
By submitting your order, you are offering to buy the goods and allowing us to use your personal details for the purposes of purchasing and supplying those goods, including passing your personal details to couriers. Your personal details can be removed from our system on request.
Payments
All payments are made on-line by credit or debit card, using the secure Stripe server, where we accept Mastercard, Visa, American Express, Maestro and Switch. Credit, Debit and Charge cards are accepted without surcharge.
We can also take payment via PayPal and by Bank Transfer however payment charges must be paid by the customer
To ensure that your credit, debit or charge card is not being used without your consent and you are over the age of 18, we will validate name, address and other personal information supplied by you during the order process against appropriate third-party databases. By accepting these Terms and Conditions, you consent to such checks being made.
In performing these checks, personal information provided by you may be disclosed to a registered Credit Reference Agency, which may keep a record of that information. This is done only to confirm your identity, a credit check is not performed and your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998 and the General Data Protection Regulation - GDPR (2018)
In the interests of protecting both the card holder and us against fraud we reserve the right to deliver any order to the cardholders billing address and you may be asked to provide us with proof of your address at any time. If you refuse to provide us with this evidence, your order may be cancelled.
If you are using a credit card not belonging to yourself, you must give the cardholder's full name and address. We will then contact the cardholder to obtain approval and commence other security checks.
Cancellations
You may cancel any order before it has been shipped. Once your order has been shipped our returns policy will then come into effect.
Please note that the only way to cancel an order is by contacting us by telephone or by email.
If you cancel an order by email you must wait to receive a confirmation of the cancellation. Your order may not be cancelled until you receive this.
Shipping
It is your responsibility to make sure that we can deliver to your country before placing your order please view our shipping page.
Due to local restrictions, we cannot ship to a few destinations at present, such as Brazil, Canada, India and Russia. If you have any International shipping queries, please e-mail us stating the country of delivery and quantity required before placing your order.
Orders will dispatched within 1 working day of receipt of your order. If, for any reason this is not possible, you will be informed by email.
We use third party couriers, in most instances DHL, and as such the delivery times and dates (delivery link) are a guide only and we are not responsible for the late delivery of products
All orders are shipped in the appropriate packaging and computer tracked. We will email you the tracking information relevantto your order for you to be able to track your parcel.
We advise you to ensure somebody is present at the delivery address since orders require a signature upon delivery from someone who is over the drinking age in the country of receipt. Once goods are delivered and signed for they become your responsibility.
If your order is returned to us undelivered due to no fault of the shipper or us then you will be responsible for re-shipping charges.
Returns
If you have taken delivery of your order and are unhappy with any of the products received we will be happy to refund or exchange items providing the following criteria is met:
Shipping costs back to us are at your expense (except where the goods do not comply with statutory requirements or the item is significantly not as described).

Import duty and taxes
All alcoholic products sold by us are sold subject to UK alcohol tax. If we are exporting products to an address inside the European Union then those prices are subject to UK VAT of 20%.
For some products delivered outside of the EU, UK VAT will not be charged (this is subject to the product being bought new or on the secondary market by Native Spirits). In the case of the product being bought new and exported outside of the EU VAT will will be deducted from your invoice, however, your order could be subject to local sales taxes and duties upon arrival in the destination country. All additional charges are the responsibility of the recipient unless otherwise clearly stated by us within your order.
If your order is being shipped outside of the EU or to a destination other than the USA, it is your responsibility as the customer to pay all applicable customs fees and taxes for your country. If you do not pay these charges then your order may be abandoned and you will lose your goods as well as your money. Please check with your local authorities before placing your order with us.
United States of America
If we deliver to your state ( please see our shipping link ) then the delivery fee quoted, includes all US taxes and FDA fees. This means that you will receive your items more quickly, as they will not be held up at customs awaiting direct payment from you.
